1. General

(“FAMAKID”) provides a service through which users can purchase course literature in the form of e-books (“The Service”). To access the Service, the user must accept these terms and conditions, which constitute an agreement between the user and FAMAKID regarding the use of the Service. By activating a user account, the user agrees to be bound by the terms. FAMAKID will not save a copy of this agreement.

2. Age Limit and Account Eligibility

To be eligible to enter into an agreement with FAMAKID, create a user account, purchase a book, and use the Service, the user must:

  • Be at least 18 years old or otherwise legally capable of entering into agreements under Swedish law.
  • Provide FAMAKID with accurate information about themselves, including contact details.
  • Provide a valid payment method.

3. Registration of User Account and Account Settings

To use and access the content of the Service, the user must register and create a user account. A valid email address is required to register an account and use the Service. Users can change contact details such as email address, password, and payment method under “Account Settings” on FAMAKID's website famakid.com.

By registering an account or logging into FAMAKID, the user allows events to be recorded in connection with the account. These events are recorded to improve the user experience. The user is responsible for ensuring that no unauthorized person gains access to login credentials or passwords.

By registering an account and accepting these terms, the user allows FAMAKID to send emails for marketing purposes. The user can opt out of receiving these emails at any time, and in such cases, FAMAKID will cease sending them.

4. Technical and Geographical Requirements for Using the Service

The Service can be used via the user's computer, tablet, and/or mobile device and requires an internet connection. FAMAKID is not responsible for errors or delays due to insufficient equipment, software, or internet capacity on the part of the user. The user is entitled to register and use the Service on a maximum of three (3) devices per user account. FAMAKID reserves the right to change both the number of devices and the type of device the user can use the Service on.

5. Pricing Information

Current prices can be found on FAMAKID's website famakid.com. Prices include VAT and may vary depending on the payment method. FAMAKID reserves the right to change prices and will inform users of such changes via email or their user account.

6. Payment

Payment is made at the time of purchase. Users are charged immediately after a book is purchased. FAMAKID reserves the right to unilaterally decide at any time to refuse specific types of debit/credit cards. FAMAKID collaborates with third parties that provide payment services through which payments are processed.

7. Access Period

By purchasing a book, the user gains access to the book for a period of five (5) years from the date of purchase, which we define as ‘lifetime access.' After this period, access to the book will cease.

8. Changes to Service Terms

FAMAKID reserves the right to amend the terms and conditions. Users will be informed of changes via email or their user account at least one month in advance. If users do not accept the changes, they can stop using the Service.

9. Contract Duration and Termination

The Service is valid from the time the user activates a user account with FAMAKID until the user chooses to terminate their account or FAMAKID terminates it. Users can terminate their account at any time through their profile page on FAMAKID's website.

10. Right of Withdrawal and Complaints

Users have the right to withdraw from the purchase of the Service within 7 days from the date of purchase and will receive a full refund, provided the right of withdrawal is exercised before the withdrawal period has expired.

However, the right of withdrawal ceases if the user starts downloading or otherwise begins using the content of the Service. By starting to read or use the content, the user expressly agrees that the right of withdrawal is forfeited, even if the withdrawal period has not expired. In case of defective or incorrect Service, the user has the right to complain by contacting FAMAKID's customer service to receive compensation or correction according to applicable consumer protection regulations.

11. FAMAKID's Rights and Obligations

FAMAKID strives to offer a wide range but cannot guarantee that all course literature is always available. The Service's features and content are continuously updated and may change at any time without prior notice. The Service is provided as is, and FAMAKID has the right to close the Service for upgrades and maintenance.

12. Availability, Interruptions, and Errors

FAMAKID intends to provide the Service around the clock but cannot guarantee that the Service will always be free from errors or interruptions. FAMAKID is not responsible if the user cannot access the Service due to overload, network errors, communication errors, or faults in the user's equipment or other circumstances beyond FAMAKID's control. FAMAKID must be given the opportunity to correct deficiencies in the Service within a reasonable time without it being considered a breach of contract.

13. Use of the Service and User Responsibility

The Service and its content are owned by FAMAKID and/or FAMAKID's suppliers and are protected by copyright. The user's right to use the Service does not transfer ownership or other intellectual property rights to the user. Users may not share their user account or use the Service for commercial or public purposes. It is not permitted to copy or distribute literature or other content in the Service. Users may not manipulate or bypass technical restrictions that protect the content in the Service. If unauthorized use is suspected, the user must immediately notify FAMAKID. Users are responsible for damages caused by granting third parties access to the Service. FAMAKID reserves the right to immediately terminate or suspend the user's access to the Service if misuse is suspected.

14. Applicable Law and Dispute Resolution

These terms and conditions are governed by Swedish law. Disputes that cannot be resolved amicably shall be decided by a Swedish general court. Users can also have disputes reviewed by the Swedish National Board for Consumer Disputes (ARN).

15. User Responsibility for Uploaded Material

Users are responsible for all material they upload to FAMAKID's website. It is not permitted to upload any material that is offensive, illegal, inappropriate, or otherwise unsuitable. FAMAKID reserves the right to remove such material without prior notice and to take legal action if necessary. Users agree to indemnify FAMAKID against any claims arising from the user's uploaded material. This responsibility does not include course literature or other material provided by FAMAKID.
